1. Agreement to terms

By accessing or using ListProper ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users of listproper.com.

2. Description of service

ListProper provides a platform that helps home sellers generate buyer demand before listing. This includes AI-powered listing creation, virtual staging of property photos, and managed advertising campaigns on Facebook and Instagram. ListProper is a marketing and demand-generation tool — it is not a licensed real estate brokerage and does not provide real estate advice.

3. Eligibility

You must be at least 18 years old to use the Service. By using ListProper, you represent that you are of legal age and have the authority to enter into these terms on behalf of yourself or any entity you represent.

4. User accounts

You are responsible for maintaining the security of your account credentials. You agree to notify us immediately at support@listproper.com if you suspect unauthorized access to your account. ListProper is not liable for losses caused by unauthorized use of your account.

5. Content and intellectual property

You retain ownership of all photos and property information you upload to the platform. By uploading content, you grant ListProper a limited, non-exclusive license to use that content solely to provide the Service — including generating your listing, staging your photos, and running your ad campaign.

The ListProper platform, including its software, design, and AI-generated content, is owned by ListProper and protected by intellectual property law. You may not copy, reverse-engineer, or redistribute any part of the platform without our written consent.

6. Payments and refunds

ListProper charges a one-time flat fee per listing, billed at the time of purchase. Payments are processed securely through Stripe. All fees are in USD.

Due to the nature of AI-generated content and ad spend that is committed upon purchase, we do not offer refunds once a listing has been created and an ad campaign has been launched. If you experience a technical issue preventing service delivery, contact us at support@listproper.com within 48 hours of purchase.

7. Prohibited uses

You agree not to:

• Upload content you do not own or have the right to use
• Use the Service for any unlawful purpose
• Upload photos of properties you do not have the right to market
• Attempt to reverse-engineer or scrape the platform
• Use the Service to generate misleading or fraudulent listings
• Interfere with the platform's operation or security

8. Disclaimers

ListProper is provided "as is" without warranties of any kind, express or implied. We do not guarantee specific outcomes — including any particular number of buyer inquiries, sale price, or sale timeline. Results depend on market conditions, property characteristics, and other factors outside our control.

Virtual staging images are digitally altered representations. They are intended to help buyers visualize a property's potential and must be labeled as virtually staged in any listing where they are used.

9. Limitation of liability

To the maximum extent permitted by law, ListProper shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any claim arising from the use of ListProper shall not exceed the amount you paid us in the 30 days preceding the claim.

10. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may close your account at any time by contacting us. Termination does not entitle you to a refund for any paid services already rendered.

11. Changes to terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the platform. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.

12. Governing law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration, except where prohibited by applicable law.
